 Commercial Change of Use

Effective September 11th, 2017 DPS will require the use of eServices for all Commercial Solar Permits. When is a building permit required?

A building permit is required for all new construction, additions, alterations, and changes of use in Montgomery County and municipalities, with the exceptions of the City of Rockville and the City of Gaithersburg.  This includes decks, sheds, retaining walls, and fences.

Is there any special assistance for my project?

Preliminary Design Consultation - This is a voluntary design conference with Building Construction staff to discuss preliminary/schematic design drawings for commercial projects prior to preparation of final construction documents (working drawings, specifications, etc.).

The preliminary design consultation is intended primarily for discussing architectural designs and related site development; however, preliminary consultations may be arranged for engineering systems designs. Any commercial building construction project may request a preliminary design consultation.

Recipes For Success - This is a program aimed at assisting individuals wishing to open a new restaurant, or to expand an existing restaurant, in navigating the County's permitting and licensing process more efficiently. 

Notice regarding systems or modular furniture

Systems furniture installations will require a separate building permit and a separate electrical permit unless the full scope of the systems furniture installation, to include electrical service, is provided for under the main building permit.   

Can commercial plans be submitted electronically?

All commercial application for new construction can now be submitted using  ePlans and ePermits.  Make sure you view all the eServices online training videos or attend a training session before you apply.

When do I need a Certification of Modified Drawings? (Click here)

Plan submittal changes which provide corrections to plan review suspension comments must include a "Certification of Modified Drawings".  All of the design professional(s) responsible for the design of the project shall review all the changes from each of the disciplines and certify that the resubmitted design documents prepared under their license did, or did not, require modification as a result of any changes made.

What will the permit cost?

Permit fees are assessed in accordance with Executive Regulation 5-11AMIII, Schedule of Fees for Permits, Licenses, and Certifications -Method 2, Department of Permitting Services.

Permit Duration

The permit is valid for one (1) year from the date of issue. An extension may be applied for prior to permit expiration. For further information, contact 311 in Montgomery County or (240) 777-0311 outside of Montgomery County.

Inspection Information

Inspection requirements are attached to the approved set of plans. Inspection requests received before 12:00 noon are scheduled for the next business day (Monday – Friday). Inspection requests received after 12:00 noon are scheduled within two business days (Monday – Friday).
